TERMS AND CONDITIONS

1. General
The Lufada de Ternura, here called "Vendor", promotes and sells Baby Gi brand products at www.babygi.pt.

"Buyer" means the individual who acts / buys as the ultimate consumer, outside the scope of any business or profession. If you are not a "final consumer" we ask that you do not buy from the online store www.babygi.pt.

The Seller reserves the right not to process orders registered on the site www.babygi.pt when there are doubts as to the final consumer status of the "Buyer" or when the orders do not comply with the general conditions of sale presented herein. These conditions and general terms of sale regulate exclusively the offer, acceptance of orders, transmission and shipments made through the site www.babygi.pt.

Buyer shall provide the Seller with an e-mail address, postal mail, or other data relating to another form of contact that is correct and complete and agrees that the Seller may contact you using such data if required.

2. Right not to accept the order or cancel the purchase

The "Seller" reserves the right to cancel any order, even if it has already been confirmed, in the following situations, exempt from liability for any damages or costs:
• The product is no longer available (payment will be returned);
• The billing information is not correct or verifiable;
• The order is flagged by our Security Systems as an incorrect order or an order that is susceptible to fraud;
• Payment is not received within 2 days of the order being accepted;
• If there is evidence that the consumer is under 18 years of age;
• If there is evidence that the consumer is not an end consumer;
• If the price indicated on the site is found to be wrong;
• If the order can not be delivered to its address;

3. Data verification

All orders received are subject to verification, in particular as to the delivery address, credibility of the consumer data and verification of fraud. Suspected fraud will be reported to the competent authorities.

4. Payment Methods

Only the forms of payment available on the website and explained in the Help / FAQs section at www.babygi.pt are accepted.

5. Payment Processing

The order processing will start after the payment has been received. Failure to pay a reference within 2 business days after the respective order can significantly condition the continuity of stock of the product (s) ordered. Payments can only be processed if the billing information can be verified.

6. Order security

Your payment information will be encrypted in the Paypal system from the moment you enter until your transaction is processed and will not be stored on a public server. Although we use encryption software, the security of information and payments transmitted over the Internet or via email can not be guaranteed. "Seller" shall not be liable for any damages suffered as a result of the use of electronic means of communication including, but not limited to, recurring damages from failures or delays in delivery of electronic communications, interception or manipulation of electronic communications by third parties or computer programs used for communication or transmission of viruses.

7. Reservation of Property

The Lufada de Ternuras Unip. Lda owns the company's products until it has received full payment for all of these products.

8. Prices

The prices of the products presented on the website are the final prices of the sale to the consumer.

8.1. The total price
The total price specified in the "Finalize the Order" item includes taxes. Prices are quoted at the time of order confirmation, which you can print for future use.

8.2. Price Changes
The prices of the products presented in the site are subject to change. The "Seller" reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase

8.3. Price Errors
Please note that even though the website is updated with extreme attention it is possible that the price information on the site contains errors.

9. Quality and Warranty

The "Seller" does not sell on www.babygi.pt second-hand products, defective or of inferior quality to the quality standards of Baby Gi existing in the market. The main features of each product displayed on www.babygi.pt can be found on each product page. The products presented for sale on the site may not exactly match the actual clothing in terms of image and color due to the internet browser and monitor used.

All products have an ID tag attached. Do not remove the product label if you want to return the purchased product. If you decide to exercise the right to return the products purchased, the "Seller" has the right not to accept the return of products without the corresponding label, or that they have been altered in relation to its original state, where the use of the same or products is denoted damaged.

10. Shipping & Delivery

10.1. Delivery
We deliver the products from Monday to Friday. We can only fulfill a delivery of an order if the delivery address is a house or an office.

A delivery shall be deemed to be effected upon signature of the delivery receipt at the agreed upon address.

10.2. Delivery times
Delivery: up to 5 business days except for custom products that can go up to 15 working days. It is expected that the delivery period will take place on average within 48 hours. The "Vendor" makes the deliveries using an external logistics company and is governed by the availability of the same to make the deliveries. The existence of holidays, bridges or other festive events may delay delivery.

The Seller will not be liable for any breach or delay in the performance of any obligation due to an event of force majeure (event, act or omission beyond its reasonable control).

At the time of delivery, the "Buyer" must inspect the packaging for any damage. If you find that the products are damaged, the "Buyer" must not accept delivery of the order and must return it. The "Seller" will refund the amounts paid for the order as soon as the warehouse orders and completes the return process.

After receiving the order, it is important that the "Buyer" check the products delivered within a period of 15 days, as the "Seller" considers that the "Buyer" has accepted the product (s) if they do not reject it within within this period.

11. Shipping Rates

Shipping rates are stipulated upon order. The price of each national shipment can vary between 5,70 - 8  euros per CttExpresso and its international shipping by the carrier at a price of 10 euros, depending on the country of destination. This will be the first to be paid for the payment of your order.

12. Returns & Cancellations

12.1. Cancellation of the order
The "Buyer" can cancel the order without any associated cost, as long as it has not yet been sent. If the "Buyer" makes an order and wishes to cancel it, you should contact our Customer Service and ask for cancellation of the order. If this cancellation request is accepted the "Buyer" will be notified by e-mail of this decision, and the cancellation will be processed at no cost to the "Buyer". If the cancellation request is not possible, the products will be sent to the "Buyer" who, while maintaining his intention to cancel the order, should refuse to receive them. The products will be returned and, after receipt, will be processed the refund of the value of the article (s).

The shipping costs originated by the non-acceptance of the order will be borne by the "Buyer".

12.2. Return of defective products

The supplier of goods or services shall reimburse the consumer for all payments received, including the costs of delivery of the goods
The "Buyer" has the right to return the products delivered when they are found to have defects or other nonconformities. The refund will be made within 14 days from the date we are informed of the decision to return the product, including the costs of delivery of the goods pursuant to paragraph 2 of article 13 of Decree Law 24/2014 of February 14th. If your claim is justified, the price of the product (s) ordered and the shipping costs (when supported by the "Buyer") will be refunded to the customer's account. 12.3 Return of products by withdrawal

If for any reason the "Buyer" is not satisfied with the products you have ordered, you may return them within 15 days of receiving the order provided that:
• The products have not been washed or used. Except in cases where the product contains information to the contrary, the "Buyer" has the right to try on the clothes to test the size and shape but can not use them.
• The product retains its original characteristics and the packaging is not damaged (carefully opened containers will not be considered damaged);
• The product is complete;
You can not return:
• Products that have been tampered with and whose name tag is damaged.
The shipping costs originated by the return by withdrawal will be borne by the "Buyer".

12.4. Product exchange

Currently it is not allowed to exchange products. However, the "Buyer" has the return option available. If you want to order another color or another item you will need to place a new order in the online store.
The shipping costs originated by the return will be borne by the "Buyer".

12.5. Refund information

Refunds will be made based on the form of payment used. The Buyer will receive the Paypal refund on your credit card account after the product (s) has been returned and processed. For more information about the return procedure and refund times see the Help / FAQ section of the site.

13. Customer Support

Only the forms of payment available on the website and explained in the Help / FAQs section at www.babygi.pt are accepted. 

14. Availability

The satisfaction of the orders registered in the site is subject to the availability of the respective products. The "Seller" tries to ensure that there is stock all the items put up for sale on the site are in stock. However, "Seller" reserves the right not to accept any orders or cancel orders already confirmed for products that are unavailable. In these cases the "Seller" will inform the "Buyer" of such fact and will refund the amount paid.

15. Validity of the promotion

The site promotions are valid only for the period in which they are displayed, except when communicated on the site information to the contrary. "Seller" is not bound by any offer. In the event of errors or mispronunciations of spelling, prices, or otherwise, in the information on the site, "Seller" reserves the right to cancel any purchase and sale concluded under such errors.

16. Liability

The Seller will only be liable for damages suffered by the Buyer in the event that such damages result from breaches attributable to the Seller's contractual obligations to the Buyer or in the event that Seller's liability arises as a result of the applicable legal right .
If the "Buyer" has suffered damages related to the activity of the site, the responsibility of the "Seller" will be limited to:

• Damage to Baby Gi products;
• The maximum reimbursement of the compensation referred to above will (if applicable) be the price of the products concerned.

The "Seller" shall not be liable for damages suffered by third parties resulting from the use of any of our products. The "Seller" shall not be liable for damages suffered by the "Buyer" as a consequence of improper use of its products.

The "Seller" is not liable for damages resulting from incorrect information on the site.

In the event that the "Buyer" suffers damages resulting from gross negligence or willful misconduct on the part of the Seller, none of the limitations set forth in this Article apply.

17. Applicable law

The present general conditions and all emerging litigations that are related to these general conditions, including their validity, the use of the site, or any purchase in the same, must be governed by the Portuguese Law.

18. Change of terms and conditions for the seller

The "Seller" has the right to change these Terms & Conditions at any time. The Buyer is subject to the principles and terms in force at the time of ordering, unless the law or competent authority imposes any changes thereto.

19. Information on the site

Although "Seller" works your site with care, information, text, graphics, movies, music and / or other services may contain errors or be incomplete or incorrect. "Seller" shall not be liable for any damages resulting from the use (or inability to use) the site, including damages caused by viruses or any inaccuracy or imperfection of the information, unless such damage results from negligence on the part of the "Seller" .

20. Trademarks and copyrights of the site

All trademarks, design, texts, documents, movies, music, product names, other site materials and titles used on the site are the property of the "Seller", being the user / consumer unable to use or reproduce any of these items. Users / consumers are only allowed to copy electronically and print portions of the site if necessary to place an order or to use the site as a source for the purchase. The user / consumer is not authorized to make any other use of the site or the information and materials contained therein, including reproduction for purposes other than those mentioned above, modification, distribution or republication. If the user / consumer wishes to use information or materials from the site, he / she must obtain prior written authorization granted by the "Seller".
